This is the standard license text. When you buy, you receive a personalised copy of this license stamped with your name, order number, licensed track or collection, and the other order details.

1. The Agreement

This Personal Music License Agreement is between Bojana Radovanovic, an individual trading as Bojana Music (the “Licensor”), and the person identified above (the “Licensee”).

This License applies only to the musical recording identified above, including the composition and master recording embodied in the supplied audio file (the “Music”).

The License becomes effective only after:

  • the full purchase price has been successfully paid;
  • the Licensee has accepted this License and the applicable Terms of Sale at checkout; and
  • the order has not been cancelled, refunded or reversed.

By downloading, accessing or using the Music, the Licensee also confirms acceptance of this License.

2. Personal Use Granted

Subject to full compliance with this License, the Licensor grants the Licensee a limited, perpetual, worldwide and non-exclusive right to:

  • listen to the Music privately for the Licensee’s own personal enjoyment, rest and relaxation;
  • store the Music on devices owned or controlled by the Licensee;
  • make a reasonable number of backup copies solely for the Licensee’s permitted personal use; and
  • convert the file into another ordinary audio format solely for compatibility with the Licensee’s personal devices.

This License grants only the personal-use rights expressly stated above. No ownership or other copyright interest in the Music is transferred to the Licensee.

3. Prohibited Uses

The Licensee must not use the Music for any public, shared, professional, promotional, commercial, business-related or monetised purpose.

Prohibited uses include, without limitation:

  • uploading or publishing the Music on YouTube, TikTok, Instagram, Facebook, Twitch, a podcast platform, a website or any other public or shared platform;
  • synchronising the Music with a video, film, advertisement, podcast, livestream, social media post, online course or other content;
  • using the Music in monetised content or in connection with a product, service, brand, business or professional activity;
  • playing the Music in a shop, studio, spa, clinic, salon, office, hotel, venue or other business premises;
  • playing the Music during a class, workshop, treatment, therapy session, client session, event or public performance;
  • using the Music in an application, game, software product, digital platform, subscription service, template, music library or other product or service; or
  • using the Music in any manner intended to generate income, promote a business or provide value to clients, customers, members or the public.

For the purposes of this License:

“Commercial Use” means any use connected with a business, profession, paid service, monetised activity, advertising, marketing, promotion or other direct or indirect financial benefit.

“Public Performance” means playing or communicating the Music outside the Licensee’s strictly private personal setting, including playback to clients, customers, students, members, attendees or the general public.

A Commercial or Business license must be purchased before making any such use.

4. No Sharing, Transfer or Redistribution

The Licensee must not:

  • sell, resell, share, gift, lend, transfer, distribute or otherwise provide the Music or its files to another person;
  • upload the Music to shared storage, a file-sharing service or any location from which another person may access or download it;
  • sublicense, rent or license the Music to another person or business;
  • include the Music in a sample pack, template, music library, digital product or other collection;
  • claim to have composed, created or acquired ownership of the Music; or
  • remove or alter ownership, copyright or identification information supplied with the Music.

Possession of a copy of the Music or this License PDF does not grant rights to any person other than the named Licensee.

5. Generative Artificial Intelligence

The Licensee must not use the Music, in whole or in part:

  • to train, fine-tune, test, evaluate or develop a generative artificial intelligence or machine-learning model;
  • as part of a training, reference or evaluation dataset for the generation of music, sound or other audio;
  • to clone, imitate or reproduce the musical style, sound or characteristics of the Music through a generative system; or
  • to generate a new musical recording, composition, sound recording or audio product.

This restriction does not prohibit ordinary non-generative tools used solely for private file playback, storage, format conversion or basic technical processing, provided that the Music is not retained or used to train or develop an artificial intelligence model.

6. Content Identification and Rights-Management Systems

The Licensee must not register, submit, upload or claim the Music, in whole or in part, through:

  • YouTube Content ID;
  • Meta Rights Manager;
  • an audio-fingerprinting service;
  • an automated copyright-claiming service;
  • a performing-rights or collective rights-management registration made in the Licensee’s name; or
  • any similar content-identification, ownership or rights-management system.

The Licensee must not take any action that could create a copyright claim, ownership claim, revenue claim, restriction or automated notice against the Licensor or another authorised user of the Music.

7. Ownership and Reserved Rights

The Music was created by and is owned or controlled by Bojana Radovanovic, trading as Bojana Music.

The Licensor retains all copyright, master recording rights and all other rights in the Music that are not expressly granted under this License.

The Licensor may:

  • use, publish, distribute and commercially exploit the Music;
  • make the Music available through streaming and social media platforms;
  • sell or grant the same or similar licenses to other persons; and
  • withdraw the Music from future sale without affecting valid licenses previously granted.

Distribution of the Music through Spotify, Apple Music, TikTok or another service does not grant the Licensee or any platform user rights beyond those provided by the relevant platform for ordinary listening.

8. Delivery and Files

The Personal Music License is supplied as:

  • one high-quality MP3 audio file; and
  • one personalised license PDF containing the Licensee’s order information.

The Music is supplied as a digital download.

The Licensee is responsible for using a compatible device, media player and software. This does not limit the Licensor’s responsibility where the Music or download supplied by the Licensor is defective, materially different from its description or otherwise fails to comply with mandatory consumer law.

Any ability to download the file again is a technical service and does not expand the rights granted under this License. The Licensee should retain a personal backup copy.

9. Wellness and Medical Disclaimer

The Music is intended as a companion for personal rest, relaxation and ordinary listening.

It is not medical or psychological advice, diagnosis or treatment and is not a substitute for care from a qualified healthcare professional.

The Licensor does not promise or guarantee any particular physical, psychological, therapeutic, wellness, sleep or health outcome from listening to the Music.

10. Consumer Rights and Digital Content

Nothing in this License excludes, restricts or replaces any mandatory right or remedy available to a consumer under applicable law.

Where required by applicable law, the Music must:

  • be supplied as described;
  • be accessible in the stated file format;
  • possess the quality and functionality reasonably expected from the product description; and
  • be free from a defect that prevents ordinary permitted use.

If the correct Music is not supplied, the download is corrupted or unusable, or the Music is materially different from its description, the Licensee should contact the Licensor using the contact details below.

Withdrawal rights, refunds, replacement downloads and remedies for defective or non-conforming digital content are governed by the applicable Terms of Sale and mandatory consumer law.

11. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, the Licensor is not responsible for:

  • a result or benefit that the Licensee expected but that was not expressly promised;
  • loss caused by use of the Music outside the scope of this License;
  • incompatibility or failure caused solely by the Licensee’s device, software or digital environment where the applicable technical requirements were clearly disclosed;
  • an interruption, restriction or failure caused by a third-party platform or service outside the Licensor’s reasonable control; or
  • any business loss, loss of profit, loss of revenue, loss of opportunity or commercial loss, because this License permits personal use only.

The Licensor is not liable for loss that was not reasonably foreseeable when the contract was concluded.

Nothing in this License excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability arising from fraud or intentional misconduct and any mandatory consumer right or remedy.

12. Refunds, Chargebacks and Reversed Payments

If the purchase price is refunded, charged back, reversed or otherwise returned to the Licensee, this License automatically terminates unless the Licensor confirms otherwise in writing.

Following termination under this section, the Licensee must immediately:

  • stop using the Music; and
  • permanently delete all copies of the Music in the Licensee’s possession or control.

This section does not prevent a consumer from exercising any mandatory statutory right.

13. Termination for Breach

The Licensor may terminate this License if the Licensee materially breaches its terms.

The License may be terminated immediately for:

  • unauthorised sharing, sale, redistribution or sublicensing;
  • false ownership or authorship claims;
  • registration through Content ID or another rights-management system;
  • prohibited generative artificial intelligence use; or
  • continued commercial or public use under this Personal License.

For another breach that can reasonably be corrected, the Licensor may give the Licensee written notice and a reasonable opportunity to correct it.

Upon termination, all rights granted under this License end. The Licensee must stop using the Music and permanently delete all copies in the Licensee’s possession or control.

Termination does not affect any right or claim that arose before termination.

14. Personal and Non-Transferable License

This License is issued only to the person named in the License Details.

The Licensee may not assign or transfer this License, including through a sale, gift, inheritance, account transfer or change of ownership, without the Licensor’s prior written consent.

The Licensor may transfer this Agreement and the rights in the Music to a person or entity that succeeds to or acquires the Bojana Music business, provided that the Licensee’s existing rights are not materially reduced.

15. Entire Agreement and Order of Precedence

This License, the applicable Terms of Sale and the order-specific information supplied at checkout form the agreement relating to the Licensee’s purchase and permitted use of the Music.

The order-specific information identifies the Licensee, the Music, the license type, the price and the order date.

This License governs the permitted and prohibited use of the Music.

The Terms of Sale govern the ordering process, payment, digital delivery, withdrawal rights, refunds and consumer remedies.

Advertising, product descriptions and informal communications do not expand the rights granted under this License unless the Licensor expressly agrees otherwise in writing.

If any provision conflicts with mandatory applicable law, the mandatory law prevails to the extent of that conflict.

16. Severability and No Waiver

If any provision of this License is found to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted by law or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

A delay or failure by the Licensor to enforce a provision on one occasion does not waive the right to enforce that provision or another provision later.

17. Governing Law and Consumer Jurisdiction

This License is governed by the laws of the Republic of North Macedonia.

If the Licensee is a consumer, this choice of law does not deprive the Licensee of any mandatory protection available under the law of the country in which the Licensee habitually resides.

Nothing in this License requires a consumer to bring a claim exclusively before a court in the Republic of North Macedonia where the consumer has a mandatory right to bring the claim before another competent court.

Before commencing formal proceedings, the parties should attempt in good faith to resolve the matter through direct written communication, except where urgent legal relief is reasonably required.
